Time Capsule – Terms of Service

Time Capsule is an AI-powered service that transforms guided interviews about someone you love into professionally narrated audio stories (the "Service"), provided through the Time Capsule web application at createtimecapsule.com (the "App") and related backend services.

1. Introduction & Agreement

1.1 Parties and scope

1.1.1 These Terms govern your access to and use of the App and the Service, including any features, content, and related services provided by Stratara (collectively, "Time Capsule" or the "Service").

1.1.2 These Terms apply to all Users of Time Capsule.

1.2 Acceptance of the Terms

1.2.1 By doing any of the following, you confirm that you have read, understood, and agree to be bound by these Terms:

• accessing the Time Capsule website;
• starting an interview session;
• purchasing a Time Capsule; or
• accessing or using any part of the Service.

1.2.2 If you do not agree, you must not access or use the Service.

1.3 Relationship with Privacy Policy

1.3.1 Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, disclose, and protect personal data. The Privacy Policy is available at:

1.3.2 By using the Service, you acknowledge that your personal data will be processed in accordance with the Privacy Policy.

1.3.3 If anything in these Terms conflicts with the Privacy Policy regarding personal data processing, the Privacy Policy prevails.

2. Eligibility and Audience

2.1 Minimum age and capacity

2.1.1 You must be 16 years or older to use Time Capsule.

2.1.2 By using the Service, you represent and warrant that:

• you are at least 16 years old; and
• you have the legal capacity to enter into a binding contract.

2.2 Intended use

2.2.1 Time Capsule is designed for personal use to create stories about people you care about (family members, friends, partners, etc.).

2.2.2 You may only create Time Capsules about real people with whom you have a genuine personal relationship or connection.

2.3 Geographic availability

2.3.1 The Service may be available globally, but we do not guarantee availability in every country.

2.3.2 We may restrict access to the Service in territories where local laws or regulations require it.

3. Description of the Service

3.1 Core concept

3.1.1 Time Capsule is an AI-powered service where you participate in a guided interview about someone you love. The interview is conducted by "Edmund S. Grey," a fictional AI family archivist character.

3.1.2 Based on your interview responses, our AI systems research relevant historical and biographical context, write a narrative story (approximately 5,000+ words), and produce a professionally narrated audio version.

3.2 What you receive

3.2.1 Upon completion of processing, you receive:

• A written story based on your interview;
• A professionally narrated audio version of the story;
• Access to download these files for a limited period (typically 30 days).

3.3 Processing time

3.3.1 Story generation typically takes several days after your interview is complete. Processing times may vary based on demand and complexity.

3.4 Service changes

3.4.1 We may update, modify, or improve the Service over time, including the AI systems, interview process, and output formats.

4. The Interview Process

4.1 Conducting the interview

4.1.1 Interviews typically take 15-20 minutes and can be completed via text or voice input.

4.1.2 Edmund S. Grey, our AI interviewer, will ask you questions about the person you're creating a Time Capsule for. You should answer honestly and share genuine memories and stories.

4.2 Content guidelines

4.2.1 You agree that the information you provide:

• is truthful to the best of your knowledge;
• concerns a real person with whom you have a genuine relationship;
• does not contain defamatory, illegal, or harmful content;
• does not violate the privacy or rights of others in a way that would be harmful.

4.3 Third-party information

4.3.1 The stories you create will contain information about real people. You are responsible for ensuring that sharing this information is appropriate and does not violate the rights of the person the story is about or any other individuals mentioned.

5. AI Processing and Research

5.1 How AI is used

5.1.1 Time Capsule uses AI systems to:

• Conduct the interview through Edmund S. Grey;
• Research relevant historical and biographical context from public sources;
• Write the narrative story;
• Generate audio narration.

5.2 Third-party AI providers

5.2.1 We use third-party AI service providers to deliver certain features. By using the Service, you acknowledge that your interview content will be processed by these providers.

5.3 AI limitations

5.3.1 AI-generated content may contain inaccuracies, creative interpretations, or errors. The story is based on your input and publicly available information, but we cannot guarantee complete accuracy.

5.3.2 You should review your story and understand it may contain AI-generated embellishments or interpretations of the information you provided.

6. Pricing and Payment

6.1 Pricing

6.1.1 Time Capsule is offered as a one-time purchase. The current price is displayed at checkout (currently $19 USD per story).

6.1.2 No subscription is required. You pay once and receive your completed story.

6.2 Payment processing

6.2.1 Payments are processed through third-party payment providers. We do not store your payment card details.

6.3 Refunds

6.3.1 Due to the personalized nature of the Service, refunds are generally not available once story processing has begun.

6.3.2 If you experience technical issues that prevent delivery of your story, please contact [email protected] and we will work to resolve the issue or provide a refund where appropriate.

7. Your Content: Ownership and Licence

7.1 Your input

7.1.1 You retain ownership of the memories, stories, and information you share during the interview ("Your Input").

7.2 Licence to Stratara

7.2.1 You grant Stratara a limited, non-exclusive licence to use Your Input solely to:

• Process the interview and generate your story;
• Conduct research to enhance the story;
• Deliver the Service to you.

7.3 The generated story

7.3.1 The story and audio narration generated from your interview are created for your personal use. You may share them with family and friends.

7.3.2 You may not commercially exploit, resell, or publicly distribute the generated content without our prior written consent.

8. Privacy and Data

8.1 Privacy by design

8.1.1 We design Time Capsule with privacy in mind. Your interview data and stories contain personal information about you and the people you love.

8.2 Data deletion

8.2.1 Your interview data is deleted from our systems shortly after your story is generated and delivered.

8.2.2 Your completed story remains available for download for approximately 30 days, after which it is removed from our servers. You should download and save your story during this period.

8.3 Your responsibility

8.3.1 Once you download your story, you are responsible for how you store, share, and use it. Consider the privacy of the people mentioned in the story when sharing it with others.

9. Acceptable Use

You agree not to use Time Capsule to:

• Create stories about fictional characters, celebrities you don't know personally, or people without a genuine personal connection;
• Include defamatory, harassing, or illegal content;
• Violate the privacy or rights of others;
• Attempt to manipulate or abuse the AI systems;
• Use the Service for any commercial purpose without our consent;
• Reverse engineer or attempt to extract the underlying AI systems or prompts.

10. Intellectual Property

10.1 Stratara owns all rights to the Service, including the Time Capsule brand, the Edmund S. Grey character, the underlying AI systems, and the story generation methodology.

10.2 You may not use our trademarks, branding, or character names without our written permission.

11. Disclaimers

11.1 Service provided "as is". To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind.

11.2 AI disclaimer. We do not guarantee that AI-generated stories are completely accurate, error-free, or suitable for any particular purpose. Stories may contain creative interpretations or inaccuracies.

11.3 Research limitations. Historical and biographical research is based on publicly available information and may be incomplete or contain errors.

11.4 Emotional content. Time Capsule deals with personal memories and relationships. We are not responsible for emotional reactions to the generated content.

12. Limitation of Liability

12.1 Cap on liability. To the maximum extent permitted by law, Stratara's total liability will not exceed the amount you paid for the Service (currently $19).

12.2 Excluded damages. To the maximum extent permitted by law, Stratara will not be liable for any indirect, incidental, special, consequential, or punitive damages.

12.3 Non-waivable rights. Nothing in these Terms excludes or limits liability where it cannot be excluded by law.

13. Governing Law

13.1 These Terms are governed by the laws of the State of Israel, excluding conflict-of-law rules.

13.2 Subject to any mandatory consumer protection rules, the competent courts in Israel will have jurisdiction over disputes arising from these Terms.

13.3 If you are a consumer in the EEA/UK, you may have the right to bring claims in your local courts.

14. Changes to these Terms

14.1 We may update these Terms from time to time.

14.2 If changes are material, we will provide notice on the website or through other reasonable means.

14.3 Your continued use of the Service after updates constitutes acceptance of the updated Terms.

15. Miscellaneous

15.1 Entire agreement. These Terms, together with the Privacy Policy, form the entire agreement between you and Stratara regarding Time Capsule.

15.2 Severability. If any provision is held invalid, the remaining provisions remain in effect.

15.3 No waiver. A failure to enforce any provision is not a waiver.

15.4 Assignment. You may not assign these Terms without our consent.
