1. Acceptance of Terms

By accessing or using POTUS Presidential Simulation ("POTUS," "the Game," or "the Service") operated by Stratara Ltd ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 16 years old to use POTUS. By using the Service, you represent and warrant that you:

• Are at least 16 years of age
• Have the legal capacity to enter into these Terms
• Are not prohibited from using the Service under applicable laws
• Will comply with these Terms and all applicable laws

3. Account Registration and Security

3.1 Account Creation

To access POTUS, you must create an account using a valid email address. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account

3.2 Account Sharing

You may share your account with members of your household. However, you remain responsible for all activities and purchases made through your account.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account. Notify us immediately at [email protected] if you suspect unauthorized access to your account.

4. The Service

4.1 Description

POTUS is an interactive presidential simulation game where players make decisions as the President of the United States through voice conversations with AI advisors. The Service includes:

• Voice-based gameplay with AI characters
• Scenario-based decision making
• Real-time consequence simulation
• Game progress tracking

4.2 Service Availability

While the Game is free to download, gameplay requires purchasing in-game credits. We do not guarantee uninterrupted access to the Service and may:

• Perform maintenance or updates
• Modify or discontinue features
• Experience technical difficulties
• Suspend service for security reasons

5. Purchases and Payment

5.1 In-Game Credits

• POTUS uses a credit system for gameplay
• Credits are required to play scenarios
• Credits are purchased through in-app purchases
• Prices are displayed in your local currency
• All prices are subject to change with notice

5.2 Payment Processing

• iOS purchases are processed through Apple Pay
• Web purchases may be processed through other payment providers
• We do not store payment card information
• You are responsible for any taxes or fees

5.3 Refund Policy

• Unused Credits: Refundable within 14 days of purchase if completely unused
• Partially Used Credits: Non-refundable once any credits are consumed
• Technical Issues: We may offer refunds or credit restoration for service failures
• iOS Purchases: Subject to Apple's refund policies

All refund requests should be sent to [email protected] with proof of purchase.

5.4 No Guarantee of Value

Virtual credits have no real-world value and cannot be:

• Exchanged for cash
• Transferred between accounts
• Sold or traded to other users

6. User Conduct

6.1 Acceptable Use

You agree to use POTUS only for lawful purposes and in accordance with these Terms. You will not:

• Violate any applicable laws or regulations
• Impersonate any person or entity
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to the Service
• Interfere with the Service's operation

6.2 Prohibited Activities

The following activities are strictly prohibited and may result in immediate termination:

• Cheating: Exploiting bugs, using automated tools, or manipulating the payment system
• Inappropriate Content: Creating or sharing offensive, hateful, or sexually explicit content through the Service
• Payment Fraud: Using stolen payment methods, chargebacks without cause, or payment manipulation
• Reverse Engineering: Decompiling, disassembling, or reverse engineering any part of the Service
• Commercial Use: Using POTUS for commercial purposes without written permission
• Data Scraping: Using automated systems to extract data from the Service
• AI Training: Using the Service or its content to train artificial intelligence models

7. Intellectual Property

7.1 Our Property

All content in POTUS, including but not limited to:

• Game design, mechanics, and scenarios
• Character personalities and dialogue
• Visual and audio assets
• Software code and algorithms
• Trademarks and logos

Are owned by Stratara Ltd or licensed to us and are protected by intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use POTUS for personal entertainment
• Share your gameplay experiences in accordance with these Terms

7.3 User Content

By playing POTUS, you may generate content including:

• Game decisions and outcomes
• Presidential legacy summaries
• Gameplay statistics

You grant us a worldwide, non-exclusive, royalty-free, perpetual license to use this content:

• In anonymized form for marketing and promotional purposes
• To improve the Service
• For analytical and research purposes
• To showcase gameplay examples

You retain ownership of any personal narratives or creative expressions you create while playing.

8. Privacy and Data Protection

Your use of POTUS is subject to our Privacy Policy, available at Privacy Policy. By using the Service, you consent to our collection and use of information as described in the Privacy Policy.

9. Third-Party Services

POTUS integrates with third-party services including:

• Supabase (authentication)
• ElevenLabs (voice AI)
• Anthropic Claude (game AI)
• Apple Pay (payments)

These services have their own terms and privacy policies. We are not responsible for third-party services or content.

10. Disclaimers

10.1 "As Is" Service

POTUS is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of content

10.2 No Guarantee

We do not guarantee that:

• The Service will meet your requirements
• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components

10.3 Political Content

POTUS is a work of fiction for entertainment purposes. Any resemblance to real persons, governments, or events is coincidental. We do not endorse any political views expressed in gameplay.

11. Limitation of Liability

11.1 Liability Cap

To the maximum extent permitted by law, our total liability for any claims under these Terms shall not exceed the greater of:

• The amount you paid us in the 12 months before the claim arose
• US$100

11.2 Exclusions

We shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages from service interruptions
• Damages from third-party services
• Content generated by AI during gameplay

11.3 Essential Purpose

These limitations apply even if remedies fail of their essential purpose and regardless of the legal theory.

12. Indemnification

You agree to indemnify, defend, and hold harmless Stratara Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use of the Service
• Your violation of any rights of another party
• Your violation of applicable laws

13. Termination

13.1 Termination by You

You may terminate your account at any time by:

• Requesting account deletion at [email protected]
• Uninstalling the Game from your devices

13.2 Termination by Us

We may suspend or terminate your account immediately for:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended inactivity (over 3 years)
• At our sole discretion with notice

13.3 Effect of Termination

Upon termination:

• Your access to POTUS will cease
• Unused credits are forfeited (no refunds)
• Your game data may be deleted
• Sections of these Terms that should survive will remain in effect

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of Israel, without regard to conflict of law principles.

14.2 Arbitration

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in Israel, except where prohibited by law. You waive any right to a jury trial or class action.

14.3 Exceptions

You may bring claims in small claims court if eligible. Either party may seek injunctive relief for intellectual property violations.

15. General Provisions

15.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Stratara Ltd regarding POTUS.

15.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full effect.

15.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.

15.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

15.5 Force Majeure

We shall not be liable for failures caused by circumstances beyond our reasonable control, including acts of God, war, terrorism, pandemic, or internet infrastructure failures.

16. Updates to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms with a new "Last Updated" date
• Sending an email notification
• Requiring acceptance for continued use

Your continued use after changes constitutes acceptance of the updated Terms.

17. Beta and Testing Programs
